NEW YORK CIVIL PRACTICE LAW AND RULES (CPLR) New York State | For Informational Purposes Only CPLR § 10003 Pending and subsequent proceedings § 10003. Pending and subsequent proceedings. This act shall apply toall actions hereafter commenced. This act shall also apply to allfurther proceedings in pending actions, except to the extent that thecourt determines that application in a particular pending action wouldnot be feasible or would work injustice, in which event the formerprocedure applies. Proceedings pursuant to law in an action taken priorto the time this act takes effect shall not be rendered ineffectual orimpaired by this act.
