NEW YORK CIVIL PRACTICE LAW AND RULES (CPLR) New York State | For Informational Purposes Only CPLR § 1203 Default judgment § 1203. Default judgment. No judgment by default may be enteredagainst an infant or a person judicially declared to be incompetentunless his representative appeared in the action or twenty days haveexpired since appointment of a guardian ad litem for him. No defaultjudgment may be entered against an adult incapable of adequatelyprotecting his rights for whom a guardian ad litem has been appointedunless twenty days have expired since the appointment.
