NEW YORK CIVIL PRACTICE LAW AND RULES (CPLR) New York State | For Informational Purposes Only CPLR § 1209 Arbitration of controversy involving infant, judiciallydeclared incompetent or conservatee § 1209. Arbitration of controversy involving infant, judiciallydeclared incompetent or conservatee. A controversy involving an infant,person judicially declared to be incompetent or conservatee shall not besubmitted to arbitration except pursuant to a court order made uponapplication of the representative of such infant, incompetent orconservatee; provided, however, that a claim brought on behalf of aninfant pursuant to paragraph one or two of subdivision (f) of sectionthree thousand four hundred twenty of the insurance law may be submittedto arbitration without a court order.
