NEW YORK CIVIL PRACTICE LAW AND RULES (CPLR) New York State | For Informational Purposes Only CPLR § 1313 Debt or property subject to attachment; proper garnishee § 1313. Debt or property subject to attachment; proper garnishee. Anydebt or property against which a forfeiture judgment may be enforced asprovided under this article is subject to attachment. The propergarnishee of any such property or debt is the person designated as aproper garnishee for purposes of enforcing money judgments in sectionfive thousand two hundred one of this chapter. For the purpose ofapplying the provisions to attachment, references to a "judgment debtor"in section five thousand two hundred one and in subdivision (i) ofsection one hundred five of this chapter shall be construed to mean"defendant".
