NEW YORK CIVIL PRACTICE LAW AND RULES (CPLR) New York State | For Informational Purposes Only CPLR § 1316 Order of attachment on notice; temporary restraining order;contents § 1316. Order of attachment on notice; temporary restraining order;contents. Upon a motion on notice for an order of attachment, the courtmay, without notice to the defendant, grant a temporary restrainingorder prohibiting the transfer of assets by a garnishee as provided insubdivision two of section one thousand three hundred twenty of thisarticle. The contents of the order of attachment granted pursuant tothis section shall be as provided in subdivision one of section onethousand three hundred seventeen of this article.
