NEW YORK CIVIL PRACTICE LAW AND RULES (CPLR) New York State | For Informational Purposes Only CPLR § 1321 Levy upon personal property by seizure § 1321. Levy upon personal property by seizure. If the claimingauthority shall so direct the collecting agent, as an alternative to themethod prescribed by section one thousand three hundred twenty of thisarticle, shall levy upon property capable of delivery by taking theproperty into his actual custody. In cases in which the collecting agentis a sheriff, the sheriff may require that the claiming authorityfurnish indemnity that is either satisfactory to the sheriff or is fixedby the court. The collecting agent shall within four days serve a copyof the order of attachment in the manner prescribed by subdivision oneof section one thousand three hundred twenty of this article upon theperson from whose possession or custody the property was taken.
