NEW YORK CIVIL PRACTICE LAW AND RULES (CPLR) New York State | For Informational Purposes Only CPLR § 1322 Levy upon real property § 1322. Levy upon real property. The claiming agent shall levy uponany interest of the defendant in real property by filing with the clerkof the county in which the property is located a notice of attachmentendorsed with the name and address of the claiming authority and statingthe names of the parties to the action, the amount specified in theorder of attachment and a description of the property levied upon. Theclerk shall record and index the notice in the same books, in the samemanner and with the same effect, as a notice of the pendency of anaction.
