NEW YORK CIVIL PRACTICE LAW AND RULES (CPLR) New York State | For Informational Purposes Only CPLR § 1325 Garnishee's statement § 1325. Garnishee's statement. Within ten days after service upon agarnishee of an order of attachment, or within such shorter time as thecourt may direct, the garnishee shall serve upon the claiming agent astatement specifying all debts of the garnishee to the defendant, whenthe debts are due, all property in the possession or custody of thegarnishee in which the defendant has an interest, and the amounts andvalue of the debts and property specified. If the garnishee has moneybelonging to, or is indebted to, the defendant in at least the amount ofthe attachment, he or she may limit his or her statement to that fact.
