NEW YORK CIVIL PRACTICE LAW AND RULES (CPLR) New York State | For Informational Purposes Only CPLR § 1335 Temporary restraining order. 1 § 1335. Temporary restraining order. 1. Generally. If, on a motion fora preliminary injunction, the claiming authority shall show thatimmediate and irreparable injury, loss or damages may result unless thedefendant is restrained before a hearing can be had, a temporaryrestraining order may be granted without notice. Upon granting atemporary restraining order, the court shall set the hearing for thepreliminary injunction at the earliest possible time.2. Service. Unless the court orders otherwise, a temporary restrainingorder together with the papers upon which it was based, and a notice ofhearing for the preliminary injunction, shall be personally served inthe same manner as a summons.
