NEW YORK CIVIL PRACTICE LAW AND RULES (CPLR) New York State | For Informational Purposes Only CPLR § 1343 Notice of pendency; constructive notice § 1343. Notice of pendency; constructive notice. A notice of pendencymay be filed in any action brought pursuant to this article in which thejudgment demanded would affect the title to, or the possession, use orenjoyment of, real property. The pendency of such an action isconstructive notice, from the time of filing of the notice only, to apurchaser from, or incumbrancer against, any defendant named in a noticeof pendency indexed in a block index against a block in which propertyaffected is situated or any defendant against whose name a notice ofpendency is indexed. A person whose conveyance or incumbrance isrecorded after the filing of the notice is bound by all proceedingstaken in the action after such filing to the same extent as if he or shewere a party.
