NEW YORK CIVIL PRACTICE LAW AND RULES (CPLR) New York State | For Informational Purposes Only CPLR § 1345 Service of summons § 1345. Service of summons. A notice of pendency filed before anaction is commenced is effective only if, within thirty days afterfiling, a summons is served upon the defendant or first publication ofthe summons against the defendant is made pursuant to an order andpublication is subsequently completed. If the defendant dies withinthirty days after filing and before the summons served upon him or heror publication is completed, the notice is effective only if the summonsis served upon his or her executor or administrator within sixty daysafter letters are issued.
