NEW YORK CIVIL PRACTICE LAW AND RULES (CPLR) New York State | For Informational Purposes Only CPLR § 213-A Residential rent overcharge § 213-a. Residential rent overcharge. No overcharge penalties ordamages may be awarded for a period more than six years before theaction is commenced or complaint is filed, however, an overcharge claimmay be filed at any time, and the calculation and determination of thelegal rent and the amount of the overcharge shall be made in accordancewith the provisions of law governing the determination and calculationof overcharges.
