NEW YORK CIVIL PRACTICE LAW AND RULES (CPLR) New York State | For Informational Purposes Only CPLR § 3001 Declaratory judgment § 3001. Declaratory judgment. The supreme court may render adeclaratory judgment having the effect of a final judgment as to therights and other legal relations of the parties to a justiciablecontroversy whether or not further relief is or could be claimed. If thecourt declines to render such a judgment it shall state its grounds. Aparty who has brought a claim for personal injury or wrongful deathagainst another party may maintain a declaratory judgment actiondirectly against the insurer of such other party, as provided inparagraph six of subsection (a) of section three thousand four hundredtwenty of the insurance law.
