NEW YORK CIVIL PRACTICE LAW AND RULES (CPLR) New York State | For Informational Purposes Only CPLR § 3003 Action for periodic payments due under pension or retirementcontract no bar to action for future installments § 3003. Action for periodic payments due under pension or retirementcontract no bar to action for future installments. The commencement ormaintenance of an action for the recovery of payments which have becomedue under the terms of a written agreement providing for the payment ofa pension or retirement compensation or deferred compensation for aperiod of years or for life, whether or not such agreement is part of anemployment contract, shall not be deemed to bar subsequent actions torecover payments thereafter becoming due under the terms of suchagreement.
