NEW YORK CIVIL PRACTICE LAW AND RULES (CPLR) New York State | For Informational Purposes Only CPLR § 3033 Contracts to submit; enforcement of submission. 1 § 3033. Contracts to submit; enforcement of submission. 1. Any writtencontract, otherwise valid under the substantive law, to submit anyexisting or future controversy to the court pursuant to section 3031 isvalid and enforceable and shall be construed as an implied consent of theparties to the jurisdiction of the supreme court of this state to enforcethe procedure in any action under the New York simplifiedprocedure for court determination of disputes authorized by sections3031 and 3033 shall be as provided in rule 3036 adopted to implement theprovisions hereof, which is designed to promote the speedy hearing ofsuch actions and to provide for such actions a procedure that is assimple and informal as circumstances will permit. A pre-trialconference may be held relative to the disposition of questions of lawwhich might be conclusive in the action and avoid a trial.(b) Technical rules of evidence dispensed. The technical rules ofevidence shall be dispensed with to the extent specified in such rule3036.(c) Practice. The practice under this procedure relating to motions tostay or to transfer pending actions, and relating to venue, assessmentof costs, entry of judgment, judgment by default, and the continuance ofthe action in case of death or incompetency of parties shall be asprescribed in the rules adopted pursuant hereto.
