NEW YORK CIVIL PRACTICE LAW AND RULES (CPLR) New York State | For Informational Purposes Only CPLR § 3037 Appeal § 3037. Appeal. An appeal may be taken only from a judgment, or anorder determining the making of the contract or submission or thefailure to comply therewith. There shall be no appeal from anintermediate order of the court or of a judge in an action under thesimplified procedure provisions, except with the permission of the trialor appellate court, but such order or orders may be reviewed on theappeal from a judgment entered under these provisions. A decision of thetrial judge on the facts shall be final if there is any substantialevidence to support it.
