NEW YORK CIVIL PRACTICE LAW AND RULES (CPLR) New York State | For Informational Purposes Only CPLR § 4318 Conduct of trial § 4318. Conduct of trial. Unless otherwise specified in the order ofreference, the referee shall conduct the trial in the same manner as acourt trying an issue without a jury. The provisions of articleforty-four applicable to trial by the court shall apply to a referencepursuant to this article.
