NEW YORK CIVIL PRACTICE LAW AND RULES (CPLR) New York State | For Informational Purposes Only CPLR § 5204 Release of lien or levy upon appeal § 5204. Release of lien or levy upon appeal. Upon motion of thejudgment debtor, upon notice to the judgment creditor, the sheriff andthe sureties upon the undertaking, the court may order, upon such termsas justice requires, that the lien of a money judgment, or that a levymade pursuant to an execution issued upon a money judgment, be releasedas to all or specified real or personal property upon the ground thatthe judgment debtor has given an undertaking upon appeal sufficient tosecure the judgment creditor.
