NEW YORK CIVIL PRACTICE LAW AND RULES (CPLR) New York State | For Informational Purposes Only CPLR § 5238 Directions to the sheriff § 5238. Directions to the sheriff. Upon motion of any party, onnotice to the sheriff and all other parties, the court may direct thesheriff to dispose of, account for, assign, return or release all or anypart of any property or debt, or the proceeds thereof, or to fileadditional returns, subject to the payment of the sheriff's fees andexpenses. As far as practicable, the court shall direct that notice ofthe motion be given to any other judgment creditors, at the addressesshown on the judgment docket and to any persons who have secured ordersof attachment affecting any property or debt, or the proceeds thereof,sought to be returned or released.
