NEW YORK CIVIL PRACTICE LAW AND RULES (CPLR) New York State | For Informational Purposes Only CPLR § 5251 Disobedience of subpoena, restraining notice or order; falseswearing; destroying notice of sale § 5251. Disobedience of subpoena, restraining notice or order; falseswearing; destroying notice of sale. Refusal or willful neglect of anyperson to obey a subpoena or restraining notice issued, or ordergranted, pursuant to this title; false swearing upon an examination orin answering written questions; and willful defacing or removal of aposted notice of sale before the time fixed for the sale, shall each bepunishable as a contempt of court.
