NEW YORK CIVIL PRACTICE LAW AND RULES (CPLR) New York State | For Informational Purposes Only CPLR § 5511 Permissible appellant and respondent § 5511. Permissible appellant and respondent. An aggrieved party or aperson substituted for him may appeal from any appealable judgment ororder except one entered upon the default of the aggrieved party. Heshall be designated as the appellant and the adverse party as therespondent.
