NEW YORK CIVIL PRACTICE LAW AND RULES (CPLR) New York State | For Informational Purposes Only CPLR § 5711 Where appeal heard § 5711. Where appeal heard. Except as provided in subdivision (d) ofrule 511, an appeal to the appellate division shall be brought in thedepartment embracing the county in which the judgment or order appealedfrom is entered and there heard and determined unless, in furtherance ofjustice, the appeal is sent to another department.
