NEW YORK CIVIL PRACTICE LAW AND RULES (CPLR) New York State | For Informational Purposes Only CPLR § 602 Consolidation § 602. Consolidation. (a) Generally. When actions involving a commonquestion of law or fact are pending before a court, the court, uponmotion, may order a joint trial of any or all the matters in issue, mayorder the actions consolidated, and may make such other ordersconcerning proceedings therein as may tend to avoid unnecessary costs ordelay.(b) Cases pending in different courts. Where an action is pending inthe supreme court it may, upon motion, remove to itself an actionpending in another court and consolidate it or have it tried togetherwith that in the supreme court. Where an action is pending in the countycourt, it may, upon motion, remove to itself an action pending in acity, municipal, district or justice court in the county and consolidateit or have it tried together with that in the county court.
