NEW YORK CIVIL PRACTICE LAW AND RULES (CPLR) New York State | For Informational Purposes Only CPLR § 7105 Sale of perishable property § 7105. Sale of perishable property. Upon motion with such notice asthe court may require, the court may order the sheriff to sellperishable property which has been seized. The court shall prescribethe time and place of the sale, and the manner and time in which noticethereof shall be given. Unless the court orders otherwise, the sheriff,after deducting his fees and necessary expenses, shall pay the proceedsinto court to be held pending determination of the action.
