NEW YORK CIVIL PRACTICE LAW AND RULES (CPLR) New York State | For Informational Purposes Only CPLR § 7504 Court appointment of arbitrator § 7504. Court appointment of arbitrator. If the arbitration agreementdoes not provide for a method of appointment of an arbitrator, or if theagreed method fails or for any reason is not followed, or if anarbitrator fails to act and his successor has not been appointed, thecourt, on application of a party, shall appoint an arbitrator.
