NEW YORK CIVIL PRACTICE LAW AND RULES (CPLR) New York State | For Informational Purposes Only CPLR § 7601 Special proceeding to enforce agreement that issue orcontroversy be determined by a person named or to be selected § 7601. Special proceeding to enforce agreement that issue orcontroversy be determined by a person named or to be selected. A specialproceeding may be commenced to specifically enforce an agreement that aquestion of valuation, appraisal or other issue or controversy bedetermined by a person named or to be selected. The court may enforcesuch an agreement as if it were an arbitration agreement, in which casethe proceeding shall be conducted as if brought under articleseventy-five of this chapter. Where there is a defense which wouldrequire dismissal of an action for breach of the agreement, theproceeding shall be dismissed. Provided, however, that this sectionshall not apply to any agreement contained in the standard fireinsurance policy of the state with the exception of an action to enforcethe appraisal clause pursuant to section three thousand four hundredeight of the insurance law which shall not be enforced as an arbitrationagreement.
