NEW YORK CIVIL PRACTICE LAW AND RULES (CPLR) New York State | For Informational Purposes Only CPLR § 8017 Exemption of the state and counties, and agencies and officersthereof, from fees of clerks § 8017. Exemption of the state and counties, and agencies and officersthereof, from fees of clerks. (a) Notwithstanding any other provision ofthis article or any other general, special or local law relating to feesof clerks, no clerk shall charge or collect a fee from the state, or anagency or officer thereof, for any service rendered in an action inwhich any of them is involved, nor shall any clerk charge or collect afee for filing, recording or indexing any paper, document, map orproceeding filed, recorded or indexed for the county, or an agency orofficer thereof acting in an official capacity, nor for furnishing atranscript, certification or copy of any paper, document, map orproceeding to be used for official purposes.(b) Notwithstanding any other provision of law the exemption ofsubdivision (a) of this section shall not apply to the fees of clerkswhere the action is on behalf of the New York State Higher EducationServices Corporation to recover money due as a result of default of astudent loan.
