NEW YORK CIVIL PRACTICE LAW AND RULES (CPLR) New York State | For Informational Purposes Only CPLR § 8605 Applicability § 8605. Applicability. (a) Nothing contained in this article shall beconstrued to alter or modify the other provisions of this chapter whereapplicable to actions other than actions against the state.(b) Nothing contained in this article shall be deemed to authorize theinstitution of a civil action for the sole purpose of obtaining feesincurred by a party to an administrative proceeding.(c) Nothing contained in this article shall affect or preclude theright of any party to recover fees or other expenses authorized bycommon law or by any other statute, law or rule.
