NEW YORK DOMESTIC RELATIONS LAW (Chapter 14) § 23 — Supervision of and inspection of town and city cle DRL § 23 Supervision of and inspection of town and city clerks' recordsby state commissioner of health /legislation/laws/DOM/A3 § 23. Supervision of and inspection of town and city clerks' recordsby state commissioner of health. The registration and recording of allmarriages outside the city of New York shall be under the supervision ofthe state commissioner of health. The commissioner, either personally orby an accredited representative, may at any time inspect the record andindex of marriage licenses issued by any town or city clerk andpromulgate rules and regulations for insuring complete registration.When he shall deem it necessary, he shall report cases of violation ofany of the provisions of this article to the district attorney of thecounty, with a statement of the facts and circumstances; and when anysuch case is reported to him by the state commissioner of health, theprosecuting attorney shall forthwith initiate and promptly follow up thenecessary court proceedings against the person or persons responsiblefor the alleged violation of law.
