NEW YORK DOMESTIC RELATIONS LAW (Chapter 14) § 142 — Dismissal of complaint in action by next friend to DRL § 142 Dismissal of complaint in action by next friend to annul amarriage ARTICLE 9 Action to Annul a Marriage or Declare It Void § 142. Dismissal of complaint in action by next friend to annul amarriage. Where the next friend of an infant, person with adevelopmental disability or person with a mental illness maintains anaction annulling a marriage, the court may dismiss the complaint ifjustice so requires, although, in a like case, the party to themarriage, if plaintiff, would be entitled to judgment.
