**N.Y. Fam. Ct. Act § 441. Order Dismissing Petition.** § 441. Order dismissing petition. If the allegations of a petition under this article are not established by competent proof, the court shall dismiss the petition. If a neglect petition was filed in the support proceeding, the court retains jurisdiction over the neglect petition whether or not it dismisses the support petition.
