NEW YORK CIVIL PRACTICE LAW AND RULES (CPLR) New York State | For Informational Purposes Only CPLR § 7564 Form of decision; costs upon frivolous claims andcounterclaims § 7564. Form of decision; costs upon frivolous claims andcounterclaims. (a) The decision in the arbitration proceeding shall bein the form required by sections seven thousand five hundred seven andfour thousand two hundred thirteen of this chapter and shall be filedwith the arbitration administrator.(b) The panel of arbitrators shall be empowered to award costs andreasonable attorney's fees to a successful party in an arbitration, ifthe panel finds that the action, claim, counterclaim, defense or crossclaim of an unsuccessful party is frivolous, in accordance with theprovisions and subject to the limitations of section eight thousandthree hundred three-a of this chapter. The arbitration fee paid by theclaimant shall be recoverable by the claimant in the event an award ismade to the claimant.
