To file for divorce in Nova Scotia, you must first live in the province for at least one year and be separated from your spouse for at least one year under Section 8(2)(a) of the Divorce Act. File your application at the Supreme Court of Nova Scotia (Family Division) using Form 59.46 (Joint Application) if both spouses agree, or Form 59.09 (Petition for Divorce) if contested. The filing fee is approximately CAD $291.55 for joint applications (CAD $218.05 plus $25 law stamp and HST) or CAD $320.30 for petitions, with fee waivers available for low-income filers. If filing a petition, your spouse must be personally served and has 15 clear business days to file an Answer (Form 59.10) under Rule 94.02. Both spouses must complete financial disclosure using Forms FD3 and FD7 when children or property division are involved.
