To file for divorce in Oklahoma, you must first establish that either you or your spouse has been a good-faith resident of the state for at least six consecutive months under Title 43, Section 102. Filing fees range from $183 to $268 depending on your county — fee waivers are available through an In Forma Pauperis application. After filing, serve your spouse via process server, sheriff ($50), or certified mail. Your spouse has 20 days to file an answer after service. An Automatic Temporary Injunction under Section 43-110 takes effect upon service, freezing marital assets and requiring both spouses to disclose tax returns, pay stubs, bank statements, and debt records. Oklahoma has a 10-day waiting period for divorces without children and a 90-day waiting period for divorces with minor children. If children under 18 are involved, both parents must complete a mandatory parenting education class ($15-$60) before the court will finalize the divorce.
