RULE 12.287. FINANCIAL AFFIDAVITS IN ENFORCEMENT AND CONTEMPT PROCEEDINGS Any party in an enforcement or contempt proceeding may serve upon any other party a written request to serve a financial affidavit if the other party’s financial circumstances are relevant in the proceeding. The party to whom the request is made shall serve the requested financial affidavit and file a notice of compliance within 10 days after the service of the written request. The court may allow a shorter or longer time. The financial affidavit shall be in substantial conformity with Florida Family Law Rules of Procedure Form 12.902(b) (Short Form), all sections of which shall be completed. RULE 12.290. DEPOSITIONS BEFORE ACTION OR PENDING APPEAL (a) Before Action. (1) Petition. A person who desires to perpetuate that person’s own testimony or that of another person regarding any matter that may be cognizable in any court of this state may file a verified petition in the circuit court in the county of the residence of any expected adverse party. The petition must: (A) be titled in the name of the petitioner; and (B) show: (i) that the petitioner expects to be a party to an action cognizable in a court of Florida, but is presently unable to bring it or cause it to be brought, (ii) the subject matter of the expected action and the petitioner’s interest in it, (iii) the facts which the petitioner desires to establish by the proposed testimony and the petitioner’s reasons for desiring to perpetuate it, Family Law Rules of Procedure October 1, 2025 82
