TEXAS RULES OF CIVIL PROCEDURE (March 1, 2026) Rule 776 — CONSTRUCTION PART VII - RULES RELATING TO SPECIAL PROCEEDINGS Rule 776: CONSTRUCTION No provision of the statutes or rules relating to partition shall affect the mode of proceeding prescribed by law for the partition of estates of decedents among the heirs and legatees, nor preclude partition in any other manner authorized by the rules of equity, which rules shall govern in proceedings for partition in all respects not provided for by law or these rules.
